GearBooth Privacy Policy

At GearBooth, we value our customers. You trust us with your information, and we’re serious about that responsibility. This policy explains our privacy practices for and it’s related services and tools (collectively, “GearBooth”). By visiting GearBooth you are accepting the terms of this Privacy Policy.

Information Collected or Received

GearBooth will not disclose your name, email address or other personal information to third parties without your explicit consent, except as specified in this policy.

As a GearBooth customer you are required to provide your full name and a valid email address at registration and choose a username that may later represent your identity on GearBooth’s Community platform.

In order to be able to conduct transactions on the GearBooth Marketplace we may request information from you, such as billing and payment information (including billing address, telephone number, credit card information), a telephone number, and/or a physical postal address. Credit card information on an account may be stored and used for payment purposes only. Any credit card information saved in the Saved Cards section of your GearBooth Account Profile is stored by our business partner, Braintree Payment Services.

Only your username and any comments or pictures you post will be publicly displayed and connected to your activity on the GearBooth Community Platform. However, other customers will be able to see your date joined, instrument reviews, Community Rating, items listed for sale and sold item listings throughout the rest of the site.

At this point in time, GearBooth only uses the information described in this policy to provide and improve our services and products, for billing and payments, for identification and authentication purposes, to contact customers or interested parties, and for general research and aggregate reporting.

GearBooth’s Customer Agreement requires all account owners to be at least 18 years of age (or have the permission and supervision of a responsible parent or legal guardian), therefore, this policy does not discuss use of our site, services, or tools by minors.

Choice & Control

At various points during your use of GearBooth, we may request additional information. You may change or correct your GearBooth account information, except your username, at any time.

For various reasons, GearBooth may contact you about our services or your account. Some of these messages are required, service-related messages for customers. Other messages are recommended, but not required.

If you no longer wish to use GearBooth’s services or receive service-related messages, then you may close your account.

Messages from GearBooth

Throughout your relationship with GearBooth, we may contact you. Primarily, messages are delivered by email and every account is required to keep a valid email address on file to receive messages. In some situations, GearBooth may contact you by telephone, SMS message or physical mail in order to provide you or others with customer support or to provide you with information about products and features you my find of interest.

Some messages from GearBooth are service-related and required for customers. Examples of service-related messages include, but are not limited to: a welcome/confirmation email when you register your account, notification of a purchase or offer, or correspondence with GearBooth’s support team. These messages are not promotional in nature. You may not opt-out of receiving service-related messages from GearBooth, unless you close your account.

As a customer, GearBooth may also send you messages related to certain features or your activity on the site. GearBooth may also send you news or updates about changes to our site, services, or tools. By default, customers will receive these messages via email.


GearBooth is both a marketplace and a community. We offer several features that allow customers to connect and communicate in public or semi-public spaces, such as Community Forums. Please use common sense and good judgment when posting in these community spaces or sharing your personal information with others on GearBooth. Be aware that any personal information you submit there can be read, collected, or used by others, or could be used to send you unsolicited messages. GearBooth generally does not remove content from community spaces, and your posts may remain public after your account is closed. You are responsible for the personal information you choose to post in community spaces on GearBooth.

Information Sharing & Disclosure

GearBooth will not disclose your name, email address or other personal information to third parties without your explicit consent, except as specified in this policy.

GearBooth limits access to your personal information to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.

As part of the buying and selling process, GearBooth will facilitate the sharing of information between the two customers involved in a transaction. Part of the buying or selling process means you will obtain another GearBooth customer’s email address, shipping address, and/or other information. As described in GearBooth's Customer Agreement, you have a limited license to use this information only for GearBooth-related communications or for GearBooth-facilitated transactions. GearBooth has not granted you a license to use the information for unsolicited commercial messages. Without express consent from that person, you must not add any GearBooth customer to your email or physical mailing list.

GearBooth may release your personal information to a third-party in order to comply with a subpoena or other legal requirement, or when we believe in good faith that such disclosure is necessary to comply with the law; prevent imminent physical harm or financial loss; or investigate or take action regarding illegal activities, suspected fraud, or violations of GearBooth's Customer Agreement. We may disclose personally identifiable information to parties in compliance with our Copyright Policy, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, GearBooth may disclose a name, address, country, phone number, email address and company name.

Throughout its lifetime, GearBooth may employ other companies and people to perform tasks on our behalf, and we may need to share your information with them to provide products and services to you. Examples include but are not limited to fulfilling orders, processing payments, handling billing disputes and collections, analyzing data, providing mapping services, preventing fraud, providing marketing assistance and providing customer service. GearBooth may partner with third-party services for fraud prevention and/or identity verification.

This policy does not apply to the practices of third parties that GearBooth does not own or control, or individuals that GearBooth does not employ or manage. If you provide your information to others on GearBooth or throughout the Internet, different rules may apply to the use or disclosure of the information you provide to them. GearBooth does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. GearBooth is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the GearBooth site. We encourage you to ask questions before you disclose your personal information to others.


The security of your personal information is important to us. Your GearBooth account information is protected by a password. Therefore, it is important that you protect against unauthorized access of your account and information by choosing your password carefully, and keeping your password and computer secure by signing out after using our services.

GearBooth encrypts sensitive information (such as credit card number) using secure socket layer technology (SSL). GearBooth follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once GearBooth receives it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Data Retention

GearBooth will retain your personally identifiable information for as long as is necessary or as needed to provide you services. If you no longer want GearBooth to use your information to provide you services, you may close your account at any time. GearBooth will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

You may inform us of any changes or requests in regards to your personal data, and in accordance with our obligations under local data protection law, we may update or delete your personal data accordingly.

Privacy Policy Changes

GearBooth reserves the right to modify this privacy statement at any time, so please review it periodically. We’ll communicate changes by posting a notice on the site or by email. If we make material changes to this policy you will be notified within this Privacy Policy, by email, or other places GearBooth deems appropriate.
